Spooklight SA (Spooklight) respects your privacy. This Privacy Policy explains (i) what information Spooklight collects through your access and use of, without limitation, Spooklight’s innovative augmented reality mobile applications “Storyfab” and “Kouji” available on smartphones, tablets and other mobile devices, on iOS and Android (the Apps), and to the website accessible at www.spooklight.ch and any other products and/or services available at the same URL address (together the Services); (ii) the use Spooklight makes of such information; and (iii) the security level Spooklight provides for protecting such information.

1.2. Acceptance.

By accessing and/or using the Services, you agree to the terms and conditions of this Privacy Policy and are aware that our policies may change in the future to adapt to future practices, technology or modification in the law.

2. Collected information

2.1. Type of data collected.

When you use or access the Services, Spooklight may collect your personal data such as but not limited to your name, birth date, gender, mailing address, email address, phone number, friends’ phone numbers, IP address, geolocalization information, payment information, user name and password, or other information that can be used to identify you or contact you (Personal Data). For example, Spooklight collects this information when you access and use our Services.

2.2. Third party plugins.

Spooklight also collects Personal Data from third parties plugins/websites such as without limitation MixPanel, Facebook, Fabric (Crashlytics), UXCam, Branch.io, leanplum, etc., that is provided by visitors/users who submit that Personal Data through the Services.

3. Use of collected information

Purpose of use.

Spooklight uses Personal Data that you provided to Spooklight to perform the Services for which the data was collected, such as enabling you to send messages to your friends with augmented reality content.

On compatible devices, Spooklight may use Face Data to improve the 3D animation of our characters. We do not store this data or share it with third-party websites.

4. Third party websites

Third party websites.

The Services may contain links to other websites such as Facebook, Twitter, Instagram or YouTube. Please note that this Privacy Policy does not apply to the practices of any company or individual that Spooklight does not control, nor to any websites that may be linked from the Services. You should carefully review the privacy policies of any websites that you visit from the Services to learn more about their information and privacy practices. The collection and use of your personal information shall be governed by such other party or website’s privacy policy. Spooklight shall not be held responsible for their privacy practices.

5. Communication to third parties

5.1. Outsourcing of certain Services.

Spooklight may in some limited instances communicate your Personal Data to third parties e.g. Google payment services or Apple pay to whom Spooklight outsources the performance of some Services such as payment services.

5.2. Marketing and advertising.

You expressly agree and Spooklight reserves the rights to communicate your Personal Data to Spooklight’s commercial partners or third parties for purposes of marketing, targeted advertising and statistics. You have at any time the rights to refuse such communication of your Personal Data to such third parties and to revoke your consent for such processing of your Personal Data for purposes of marketing, targeted advertising and statistics, by sending a written request to contact@spooklight-studio.com.

5.3. Legal compliance.

Spooklight will disclose Personal Data as required by law and/or by a competent authority or court, or if in our judgment it is necessary to protect Spooklight or the users of the Services from any damage, loss or liability.

Your Personal Data may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. In submitting such Personal Data, you specifically agree to that transfer.

Spooklight also uses “cookies” or other analytics tools to collect information. A cookie is a small data file that Spooklight transfers to your electronic device and is stored on your electronic device. e.g. Spooklight uses cookies or other analytics tools to measure the traffic to and usage of the Services and their different features, and other miscellaneous uses.

7.2. Settings configuration.

If you do not wish to have cookies placed on your electronic device, you should set your browser or electronic device to refuse cookies before using the Services, with the drawback that certain features of the Services may not function properly without the help of cookies.

Changes.

Spooklight may change this Privacy Policy from time to time, and at Spooklight’s sole discretion. If Spooklight does it, then Spooklight will post the amended Privacy Policy on its website. By your renewed access and use of the Services after the changes, you agree to the modified Privacy Policy. In all cases, use of information Spooklight collects is subject to the Privacy Policy in effect at the time such information is collected.

Upon request, Spooklight will provide you with a summary of the information Spooklight collects about you. Unless otherwise required by mandatory applicable law, you will have the opportunity to correct, update, modify or delete this information by sending an e-mail to contact@spooklight-studio.com.

10. Applicable law and jurisdiction

10.1. Governing Law.

1.1. This Privacy Policy shall be governed by and construed in accordance with Swiss substantive law, without reference to its conflict of laws provisions.

10.2. Jurisdiction.

1.1. Any dispute or difference arising out of or in relation to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, subject to the right of appeal to the Swiss Federal Tribunal.
